MOSAIC Privacy Policy

M.O.S.A.I.C. Multi-Lingual Orientation Service Association for Immigrant Communities (MOSAIC) respects and upholds an individual’s right to privacy and to protection of his or her personal information.

Personal information is information about an identifiable individual, excluding his or her name, title, and business contact information.

MOSAIC is committed to ensuring compliance with applicable privacy legislation. MOSAIC, its Board of Directors, employees, contractors, volunteers, and other persons and organizations who act for, or on behalf of, MOSAIC, are required to comply with this Privacy Policy.
 
This Privacy Policy may be updated by MOSAIC giving reasonable notice of the revised policy (which may include notice by e-mail or by posting at MOSAIC’s website at www.mosaicbc.com), and this Privacy Policy may be supplemented or modified by agreements entered into between MOSAIC and an individual from time to time.
 
The purpose of this Privacy Policy is to serve as a guide in the collection, use, disclosure and retention of personal information by MOSAIC. The handling and safeguarding of personal information in particular areas of MOSAIC’s operations are also guided by specific procedures and practices, developed in accordance with this Policy.
 
This Policy applies to individuals from whom MOSAIC collects personal information, including clients, program participants, members, Board members, contractors, and donors. This Policy does not apply to employee or volunteer personal information, which is covered in a separate privacy policy.
 
Access to personal information is restricted to persons or organizations acting for, or on behalf of, MOSAIC, who need the information in order to provide services to the individual or to MOSAIC.
 
Personal information is not, without consent, used or disclosed to a third party for any purpose other than that for which it was collected, unless such use or disclosure is required or allowed by law.
 
With consent, personal information may be shared with or collected from other entities or individuals.
 
In accordance with MOSAIC’s legal or contractual obligations, such as contracts with its funders, personal information may be disclosed to government departments or other entities. Where appropriate, individuals will be informed and asked to consent to such disclosure prior to collection of and/or use of such personal information.
 
From time to time, MOSAIC may wish to use photographs or other personal information on a website or in printed material. Consent will be obtained from the individual prior to any such use.

MOSAIC is accountable for the personal information under its control. MOSAIC has established this Privacy Policy, and procedures and practices, to safeguard such personal information. MOSAIC has also appointed a Privacy Officer, who is responsible for MOSAIC’s compliance with this Policy.

MOSAIC identifies, and uses reasonable efforts to communicate, the purposes for which it collects personal information either before or at the time of collection.
 
C. Consent
MOSAIC collects, uses and discloses personal information only with the consent of the individual, or as otherwise allowed by law.
 
Consent may be express, implied (including through use of “opt-out” consent where appropriate), or deemed. For example, if an individual provides his/her contact information and requests information regarding a particular service, consent to use the contact information to provide the requested information to the individual is implied.
 
On giving reasonable written notice to MOSAIC, an individual may withdraw consent to the collection, use or disclosure of his or her personal information. Upon receipt of such withdrawal, MOSAIC will notify the individual of the likely consequences of withdrawing his or her consent and, except where otherwise required or permitted by law, MOSAIC will stop collecting, using or disclosing the individual’s personal information.

MOSAIC uses reasonable efforts to only collect personal information that is necessary for the purposes identified. Personal information is collected directly from the individual, and may, with consent or as otherwise allowed by law, be collected from other sources.

MOSAIC’s Privacy Policy is available to individuals from whom MOSAIC collects personal information and also to the public. Upon written request addressed to the Privacy Officer, MOSAIC will provide a copy of this Policy, and respond to inquiries about its procedures and practices relating to personal information.
 
I. Individual access
An individual may request to be informed of the existence, use and disclosure of personal information pertaining to him or her. MOSAIC will provide appropriate access to such information that it holds. If MOSAIC determines not to provide access to personal information, an explanation will be provided.
 
Upon written request, an individual may request MOSAIC to correct an error or omission in the personal information about the individual that is under MOSAIC’s control. If MOSAIC is satisfied that a correction should be made, it will amend the information as requested and, where appropriate, will send the corrected information to organizations to which it has disclosed that information during the year prior to the date of correction.
